Digital Mountain, Inc. (“us”, “we”, or “our”) operates https://digitalmountain.com (the “Site”). This document informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site and our services. It also describes your choices regarding use, access, and correction of your personal information. Personal information is any information that identifies you or would enable someone to contact you, which may include your name, email address, phone number and other non-public information that is associated with such information. It does not include aggregate information, anonymous information, or any other non-personally identifiable information. We use your Personal Information only for providing services and improving the Site. By using the Site and/or our services, you agree to the collection and use of information in accordance with this policy.

Types of Data We Collect and Use

We may collect Personally Identifiable Information from Users in a variety of ways, including, but not limited to, when Users visit our site, subscribe to our newsletter, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number, company name. Users can always refuse to supply Personally Identification Information, except that it may prevent them from engaging in certain Site related activities.

We may also collect Personally Identifiable Information about Users whenever they interact with our Site. Personally Identifiable Information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

As part of our Services, Digital Mountain, Inc. may require log-in credentials to ensure the user is properly accessing Digital Mountain, Inc. services.

Like many site operators, we collect Personally Identifiable Information that your browser sends whenever you visit our Site (“Log Data”). When you contact us for services, we will need to collect relevant information necessary to complete the request. This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, in order to complete services requested, we may need to collect information such as usernames and logins.

Newsletters & Events – Conferences, Seminars, Panels and Web Events

Digital Mountain, Inc. is committed to providing timely information in the form of Newsletters. If you sign up to receive our Newsletters, we will collect your name, company name, and contact information, which we will store in our database(s) and use to deliver you the content. Information may further be utilized to provide supplemental marketing materials that may pertain to Digital Mountain, Inc. services pertaining to the relative subject matter.

Digital Mountain, Inc. hosts events including Seminars, Training Opportunities, Panel Discussions and Web Events. If you register for one of our events, we will collect your name, company name, and contact information, which we will store in our database(s) and use to provide you with information and services associated with the event. Information may further be utilized to fulfill any requests you have associated with the event or service. Digital Mountain, Inc. does not share this information with any third party other than to store the information in our database(s).

If you are an attendee, we may keep record of your participation. We may use this to inform you of additional events or provide you complementary resources or better understand attendee needs and interests and to adjust our products and services.

On occasion, Digital Mountain, Inc. may co-sponsor an event that provides an attendee list. If you do not wish to have your information included in an attendee list or to receive information, you can express your preferences when you register for events or contact Digital Mountain, Inc. Sharing your information with co-sponsors allows you to receive the content for free. We provide a way for attendees to opt out of receiving marketing materials.

Co-Sponsors may ask you to provide additional contact information to follow-up with questions or provide marketing information. By giving a co-sponsor your information, you are consenting that you may be contacted by that organization post-event. If you do not wish them to contact you, please communicate this directly with the organization at the event or thereafter.

Managed/Consulting Services

Digital Mountain, Inc. uses personal information as necessary for the performance of a Managed Service or Consulting contract. Information obtained through these services is used to assist with network and information security, risk assessment, threat protection, and suspicious activity that may adversely affect the client. In the event of an incident, we would examine personal data that appeared to be linked to the incident as necessary to determine what happened, remediate, report to the authorities, and prevent a recurrence.

Collected Through Our Web Site

Unless you opt-out, Digital Mountain, Inc. may use personal information obtained to:  

  • Improve customer service – information you provide helps us respond to your customer service requests and support needs more efficiently.
  • Improve our Site – we may use feedback you provide to improve our products and services.
  • To run a promotion, contest, survey or other Site feature.
  • Send periodic emails – we may use the email address to send User information or respond to their inquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us directly at the contact information listed below.

Google Analytics

Digital Mountain, Inc. uses Google Analytics, a web analytics service, to track how often people gain access to or read our content. We use this information in the aggregate to understand what content our members find useful or interesting, so we can produce the most valuable content to meet your needs. Google will not associate your IP address with any other data held by Google and if you wish to prevent your data from being used by Google Analytics you can install Google’s op-out browser add-on (www.google.com/intl/en/policies/privacy/).

Cookies and Beacons

We may place ‘cookies’ and similar technologies in your computer or mobile device in order to track and collect data regarding your use of our Site and Services. Cookies are small text files that our Site transfers to you and that permit us to recognize you and obtain data such as how, when and how long you browse pages in our Site.  Either we or our affiliates and authorized service providers may also use ‘beacons’, which are small files, sometimes only a pixel in size, embedded onto the pages of our Site. Beacons are used to identify each of our pages in order to be analyzed by our system tools. You can always configure your browser to refuse cookies and beacons.

Sharing Your Personal Information

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

How We Protect Your Information

We adopt appropriate privacy, data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. We restrict access to data based on established security best practices and frameworks and continually train employees about their commitment and importance of maintaining the confidentiality and security of personal data.

Data Retention

Digital Mountain, Inc. is dedicated to ensuring data is retained for only the amount of time necessary to provide the requested or contractual service(s), protect our assets, or in response to legal obligations. Your personal data is stored by Digital Mountain, Inc. on its servers, and on the servers of cloud-based services we engage, located in the United States. We retain data for the duration of the customer’s or client’s business relationship with Digital Mountain, Inc. and for a period of time thereafter, to analyze the data for internal operations, and for historical, archiving, or legal purposes.

Choices with Your Information

To no longer be included in Marketing or General Communication you may simply click unsubscribe to the most recent communication or contact Digital Mountain, Inc.

Inquiries and changes to data obtained through services contractually provided to clients will need to originate with the client. If we determine that a request was made directly to Digital Mountain, Inc., we will help route the request to the appropriate client to ensure a proper audit trail is performed that all data in question is properly located and changed.

Should you, as an EU, UK or Swiss individual, decide that you would like to confirm that Digital Mountain, Inc. has access to or is processing your data, would like it corrected or deleted, you may submit a request to the contact information listed below. If data cannot be provided within a reasonable amount of time, we will contact you regarding reasonable options.

Special Provisions for California Consumers

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:  

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account.

If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt.

The response we provide will also explain the reasons we cannot comply with a request, if applicable.

For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.

If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

In addition, under California’s “Shine the Light” law, you have the right to ask us once a year if we have shared your personal information with third parties for direct marketing purposes. To make a request please contact us as instructed at the end of this notice and specify you are making a Shine the Light request.

Compliance with Children’s Online Privacy Protection Act

Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our Site from those we actually know are under 13, and no part of our website is structured to attract anyone under 13.

Digital Mountain, Inc. has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF.

Digital Mountain, Inc. has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. In compliance with the Data Privacy Framework Principles, Digital Mountain, Inc. commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to the Data Privacy Frameworks. Digital Mountain, Inc. has further committed to refer unresolved privacy complaints under the Data Privacy Framework Principles to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. Third party organizations that house data and work with Digital Mountain, Inc. involving the personal data of EU, UK, and Swiss citizens are contractually obligated to provide at least the same level of privacy protection as required by the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, Digital Mountain, Inc. remains responsible and liable under the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, if third-party agents that it engages to process personal data on its behalf do so in a manner inconsistent with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF,, unless Digital Mountain, Inc. proves that it is not responsible for the event giving rise to the damage.

Digital Mountain, Inc. may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

Communication Standards

The Privacy Officer will review all marketing and communications creations to ensure consistency with company policy and regulatory requirements. The following standards will apply to marketing communication creations:

  • Shall not contain any untrue statements of material facts that are false or misleading.
  • Shall not contain any guarantees (or promise) or any language that can be viewed as a guarantee.
  • Statements, graphs, charts or infographics must be fully supported, sourced and documented.
  • Opinions must clearly indicate the statement is an opinion or assumption and not presented as a fact.
  • Shall not include “absolute” language that cannot be proven.

Security

The security of your Personal Information is important to us but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure.
